Spam Policy:
 NO Tolerance! Including but not limited to.
Abusive language
Hacking, Cracking, Phreaking or other such methods.
Flooding of any video conferencing rooms by text, creative ascii drawings or any other such methods.

Services:
 XXX-Factor is an adult entertainment website for consenting adults.
XXX-Factor members seek to utilize XXX-Factor services for his or her own viewing pleasure and purposes.
The member acknowledges that the internet is neither owned nor controlled by any one entity, therefore, XXX-Factor can make no guarantee that any given member shall be able to access XXX-Factor services at any given time.
The member acknowledges they may receive emails from XXX-Factor about special events and or site changes.
Therefore, in consideration of the promises contained herein, the member agrees as follows.

Financial Agreement:
 Member agrees to the terms, conditions contained herein and the terms, conditions of the payment processor (if any) for
XXX-Factor

TAXES:
 XXX-Factor shall not be liable for any taxes or other fees to be paid in accordance with or related to purchases made by the member from XXX-Factor services. Member agrees to take full responsibility for all taxes and fees of any nature associated with such products sold.

MATERIAL PRODUCTS:
XXX-Factor will provide member with material and data in a condition that is "user-ready", which is in a form requiring no additional manipulation on the part of XXX-Factor or its affiliates. XXX-Factor shall make no effort to validate this information for content, correctness or usability.

TRADEMARKS & COPYRIGHTS
 XXX-Factor warrants that it has the right to use the applicable trademarks, if any.

AGE:
 The Member certifies that he or she is at least 18 years of age, and will act as the "member" in terms of this contract.

INTERNET ETIQUETTE:
 Users of the video-conferencing rooms should be considerate of the expectations and sensitivities of other users in the video-conferencing rooms when posting in the rooms. The network resources of XXX-Factor may not be used to impersonate another person or misrepresent authorization to act on behalf of others or XXX-Factor. All messages transmitted via XXX-Factor should correctly identify the sender, users may not alter the attribution of origin in electronic mail messages or posting. Users must not attempt to undermine the security or integrity of computing systems or networks and must not attempt to gain unauthorized access.

TERMINATION:
 Member agrees to the terms and conditions policy of XXX-Factor
And the terms and conditions policy of the payment processor (if any). failure to adhere to either policy will be grounds for termination without refund.

LIMITED LIABILITY:
 Member expressly agrees that use of XXX-Factor Services is at members's sole risk. Neither XXX-Factor, its employees, affiliates, agents, third party information providers, merchants licensers or the like, warrant that XXX-Factor service will not be interrupted or error free, nor do they make any warranty as to the results that may be obtained from the use of the service or as to the accuracy, reliability or content of any information service or merchandise contained in or provided through the XXX-Factor service, unless otherwise expressly stated in this contract. Under no circumstances, including negligence, shall XXX-Factor, its offices, agents or any one else involved in creating, producing or distributing XXX-Factor service be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the XXX-Factor service, or that results from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission or any failure of performance, whether or not limited to acts of nature, communication failure, theft, destruction or unauthorized access to XXX-Factor records, programs or services. Member hereby acknowledges that this paragraph shall apply to all content on XXX-Factor service. Notwithstanding the above, Members's exclusive remedies for all damages, losses and causes of actions whether in contract, tort including negligence or otherwise, shall not exceed the aggregate amount which Member paid (if any) during the term of this contract and any reasonable legal fee and court costs.

LAWFUL PURPOSE:
 Member may only use XXX-Factor Services for lawful purpose. Transmission of any material in violation of any Country, Federal, State or Local regulation is prohibited. To this effect, Child Pornography Is Strictly Prohibited! as well as any copyrighted information on XXX-Factor for the purpose of illegal distribution or infringement. Member agrees to not advocate, sell or in any way make available tools or methods to send unsolicited e-mail, e-mail addresses or postings (spam), or to use XXX-Factor Servers for relaying unsolicited e-mail, e-mail addresses or postings, or to use unsolicited e-mail, e-mail addresses or postings to advertise for any web site or XXX-Factor. Any complaint we receive about a violation of this or the preceding two points will be taken very seriously and will result in immediate account cancellation without a refund.

INDEMNIFICATION:
 Member agrees that it shall defend, indemnify, save and hold XXX-Factor harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorneys' fees, ("Liabilities") asserted against XXX-Factor, its agents, its customers, servants and employees, that may arise or result from any service provided or performed or agreed to be performed. Member agrees to defend, indemnify and hold harmless XXX-Factor against Liabilities arising out of any injury to person or property caused by any products sold or otherwise distributed in connection with XXX-Factor Website.
Revisions will be considered agreed to by the Member on renewal of service as specified in Section - Financial Agreements assigned by the provider.

TRANSFER:
 Member may not transfer this account, in any way, by means of giving out user ID, Password or any other means of transfer.

CONTRACT:
 These Terms and Conditions constitutes the contract and understanding of the parties. Any changes or modifications to these Terms and Conditions of Contract thereto are agreed to by the both parties upon renewal of services.
